By entering "Harold and Kumar Go To White Castle" Giveaway at AsianConnections.com (the "Sponsor") and co-sponsors FiringSquad.com, you agree to be legally bound by these Official Rules and the Terms and Conditions of Website Use (collectively, "Terms and Conditions") contained herein just as if you had signed this Agreement. AsianConnections.com may modify these Terms and Conditions at any time.

You agree not to use any system, processes, technologies, programming, or other methods to modify, disable, subvert, or otherwise change the mechanism by which the Sweepstakes operates. Please review this Agreement from time to time since your ongoing use is subject to the Terms and Conditions as modified. You are also subject to the Privacy Statement, which is hereby made a part of and incorporated by reference into these Terms and Conditions. If you do not agree to these Terms and Conditions, do not register with AsianConnections.com and do not enter the Sweepstakes.

Sweepstakes Rules

1. To enter the Sweepstakes, click on the "Enter Sweepstakes" button and fill out the form.
2. Only one entry per person. Persons determined to have entered multiple times will be disqualified.
3. Entrants must be legal residents of the United States.
4. Winner of each prize will be randomly selected on the date specified on the Entry Page. All entries must be received by 12:01 pm PT on August 31, 2004 in order to qualify. The odds of winning a prize depends on the total number of eligible entries. Only one (1) prize will be awarded to any one (1) person, household, address, or e-mail address.
5. Participants must register a valid email and mailing address in order to claim the prize. By submitting his/her email address, winner agrees to the Sweepstakes Terms and Conditions. It is the responsibility of winner to submit the correct email and mailing address. AsianConnections.com cannot be held responsible for incorrect, invalid, or mistyped email and mailing addresses. In the event of a dispute as to the identity of an entrant, any on-line entry will be deemed submitted by the authorized account holder of the e-mail account from which it was sent. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible.
6. A notification confirming a winning entry will be sent to winner via email once an address has been submitted. AsianConnections.com will contact the winner via email in inform them of the delivery of prize(s). The winner's shipping address will be used ONLY for delivery of the prize(s).
7. Prize(s) will be sent to the winner via United States Postal System first class mail within 2-4 business weeks of receiving shipping information. Prize(s) will be sent to United States mailing addresses only.
8. Winner's initials, hometown, and state may be listed on the Winners Page on the AsianConnections.com site. No other personal information will be made available to the public.
9. AsianConnections.com agrees to exercise its best effort to ensure proper delivery of prize(s). However, Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, a winner does not respond within five (5) days of the first notification attempt, or if the prize or prize notification is returned as declined, unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules, such potential winner will be disqualified and an alternate winner may be selectedthe Sweepstakes.
10. The Sweepstakes is void where prohibited.

Prizes

Prizes are listed on the Sweepstakes page. All aspects of each prize not specifically stated on the Sweepstakes page will be determined by Sponsor in its sole discretion.

General

If you do not comply with these Terms and Conditions at any time, AsianConnections.com reserves the right to cancel your registration with AsianConnections.com and the Sweepstakes. AsianConnections.com may restrict your use of or access to the Sweepstakes at its sole discretion without prior notice. the Sweepstakes is a promotional event and forum for various different prizes to be given away on the AsianConnections.com website.

Detailed information about the prizes is provided by the manufacturers and/or retailers to AsianConnections.com solely for use on the AsianConnections.com website. The rights to this information may be protected by patent, copyright, trademark, trade secrets or other proprietary rights owned by a third party other than AsianConnections.com. Additionally, certain content displayed and contained within the AsianConnections.com website is the original authorship of AsianConnections.com and is owned exclusively by AsianConnections.com.

By registering with AsianConnections.com and the Sweepstakes, you acknowledge you may not modify, publish, transmit, display, copy, participate in the transfer or sale, create derivative works, or in any way exploit any of the content found at AsianConnections.com, whether owned by AsianConnections.com or a third party, other than as provided herein.

If the Sweepstakes is not operating as intended for any reason, including without limitation as a result of infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of AsianConnections.com that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, AsianConnections.com reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes.

AsianConnections.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. AsianConnections.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by AsianConnections.com on account of technical or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes.

The Sweepstakes is provided to you "as is" and you agree to use it at your sole risk. AsianConnections.com expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Entrants agree that AsianConnections.com, FiringSquad.com and New Line Cinema, and any of its co-sponsors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if AsianConnections.com has been advised of the possibility of such damages), resulting from:

i. the inability to participate in the Sweepstakes;
ii. the cost of procurement of substitute goods and services resulting from any goods, data, information or services won, purchased or obtained via AsianConnections.com;
iii. unauthorized access to or alteration of your transmissions or data;
iv. statements or conduct of any third party on AsianConnections.com;
v. participation in the Sweepstakes or in any Sweepstakes related activity, or from entrants' acceptance, receipt, possession and/or use or misuse of any prize; or
vi. any other matter relating to AsianConnections.com or operation of the Sweepstakes. In no event shall AsianConnections.com' total liability to you for all damages, losses and causes of action whether in contract, tort (including, but not limited to, negligence), or otherwise exceed the amount paid by you, if any, for accessing this site.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

By participating in the Sweepstakes, each entrant agrees to release and hold harmless AsianConnections.com, and each of their parent, affiliated, and subsidiary companies, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any sweepstakes related activity, use of the AsianConnections.com website, or participation in the Sweepstakes, and any claim or cause of action of any kind in connection with the Sweepstakes, including without limitation, injury, death, property damage and claims based on right of privacy or publicity, or defamation. Void where prohibited by law.

By participating in the Sweepstakes, each entrant further agrees that any dispute arising out of or relating to any sweepstakes or game offered by AsianConnections.com, its parents, affiliates, subsidiaries, advertising and promotion agencies, and their respective directors, officers, employees, representatives and agents, shall be submitted to and resolved by binding arbitration in Orange County California, pursuant to the rules and standards established by the American Arbitration Association ("AAA"), except where the rules or standards of the AAA conflict with any provision included in the rules of any sweepstakes or game offered by AsianConnections.com.

In such instance of a conflict, the entrant agrees that the arbitrator shall apply the rules of the Sweepstakes or game. By participating in this sweepstakes or game, the entrant also agrees that each entrant shall only be permitted to represent his/her own individual claims or defenses in the arbitration proceeding. Class arbitration is expressly prohibited. Further, the entrant agrees that the arbitrator shall not have the authority to award attorney's fees or costs, or to award punitive or exemplary damages.

Registration

You agree that the information you provide to AsianConnections.com is true and accurate information about you, and that you will notify AsianConnections.com if any of this information changes. If you fail to provide true and accurate information, AsianConnections.com reserves the right to terminate your registration with AsianConnections.com.
AsianConnections.com closely monitors all sweepstakes activities on the AsianConnections.com website. In the event AsianConnections.com determines that you have violated these Terms and Conditions, the Sweepstakes Rules or the Privacy Statement, it reserves the right to cancel your registration and cancel your entries from any sweepstakes you have entered.

These links are provided for your convenience and are not intended to endorse or make any representation whatsoever about the products and services found at such links. You agree to release and hold harmless AsianConnections.com, its parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, resulting from the use of the links and everything you find at the other end of those links.

Miscellaneous

These terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in the State of California and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. These Terms and Conditions, the Sweepstakes Rules and the Privacy Statement constitute the entire agreement between you and AsianConnections.com relating to the subject matter herein and shall not be modified except as provided herein. Participation in the Sweepstakes is void where prohibited by law.
